Live in Ontario? Randy takes on the 407 toll road

Toronto uber-blogger Randy Morin is sick and tired of the 407 ETR, or at least their wacky billing systems.  He's in the process of escalating a complaint through the premier's office, trying to get his bill sorted.  And in the process he's tossing around lots of loaded words like "racketeering".  Pull up a chair and enjoy the fireworks this May 24 weekend…

    Thanks Alec. I just don't know what I can do. The police won't do anything because it's only $82. Hiring a lawyer would be $250/hr. I'm stuck with paying $82 that I don't owe. Not that I can't afford $82, but hell if I'm gonna pay some scammers $82 just to make them go away.

    I told the Ministry of Transportation yesterday that I was suing them, the Ombudsman of the 407 and the 407. Today, the 407 agreed to drop all amounts owing. I still might sue them.

      Please help I'm disabled and bought an suv went to the ministry and was told had to pay 8 grand for my plates plus 2 years ago I paid 5 grand I want to sue any advise

      Apparently MTO says that "a statement from the Chief Financial Officer at 407 ETR certifying that 407 ETR has complied with the requirements of the Act in the issuance of notices." This story tells me that the statement isn't worth the paper it's written on. If you have all your documentation, I would love for you to come to the 407 ETR's offices on Thursday and show it to the media.     I made the mistake of jumping on the damn thing to get out of trafic for about 3 or 4 KMs a few times 7 or 8 years ago thinking that they would bill me later. Irresponsible ? yes! no question here! The pace of life back then was fast, (work hard,pay hard.) Nothing came until I moved out of province for while to work. I came back to find that they have been collecting interest on those very short trips ever since. The result 3 separate accounts (I drove 2 different cars) 1 for over $400 another for $488.00 and finally another for $508.00 they have blocked me from getting plates and now are on my credit report! The amounts owed are about 95% interest!!! I had no choice but to pay the first 2 so that I could drive. The third one is now about to block my plates as well! These dogs have had their way with me. I am so mad that all I want to do is join or start some sort of protest to make people aware of what our governing thieves are capable of. I think 21% or 22% (who knows ) interest is sick! but The common sense revolution still biting hard! Thank you mike!

    A search online for 407 related disputes led me to this page.

    I was shocked to see how dead end the 407 deal was. It just seems like one big mismanaged ripoff with more problems than a $2.99 webhost.

    My story is outrageous. I can't even explain it because the amount of time it would take to explain the ordeal that the 407 group has put me through over $49 dollars is not worth it.

    All I can say is that in 3 weeks of dealing with them they have let me down 4 times, provided false or unknown information several times and gave me customer service equivalent to a third world country.. you just have to take my word for it , they failed in every possible way. they seem to have a database issue or an overwhelming amount of customers problems they can't get to.

    from reading other stories it is very clear how this company runs things. they go after big bills with heavy handed tactics and for the small bills such as mine they jerk you around for weeks until you eventually have to pay it to get your plates..

    I've seriously thought about suing them but again its $49 and just not worth it. I already spent several hours of real time talking to them during the last 3 weeks or reading the procdures and claims on the website..

    The reason I took it online today was because my wife got a call at 7:19 AM from a collection agency CBCL . During this dispute the 407 said they would call in 24 hrs, then in 48hrs,, they did not call ONCE !!! I gave them the wifes cell and they passed it on to canadian bonded credits limited.

    The 407 tactic is here is clear , they ask for your phone number to update the database , I said I don't think my phone has anything to do with your toll company, they need to call for a review ! fine here is my wifes cell.. 416-******* … there is no review , no call ever, its easier to give false information to get your phone number and let heavy handed CBCL collections deal with.. I don't even want to get into that but it would seems the most corrupt and mismanaged spanish company running in Canada is also partners with the worst reputation collection agency..

    They dicked me around for weeks while reviewing something,, they fail to ever make the review , so finally I call so many times to see what the hell is going and they put me on hold for 5 minutes while a review is made , obviously stating exactly the opposite of what I want to hear on an issue not even releated to me.. outright pathetic..

    PS: these are just the outlines , If I explained each ordeal through the last 3 weeks your stomach would turn.

      All i have to say is, I hope the new government elect should do something !!…but we should see if they do !!… No matter how they how they write the law. The 407 is a business… The only thing i could think off is, some of the our politician are probably getting a kick back from them !!… Like i said time will tell if young Trudeau will do something about it !!… or is he going turn his head the other ways like other political leader have in the pass…

    I live up in North Bay haven't been to Toronto in 6 years since I've moved up here, I paid all my bills in full with the ETR with a consalidated loan i got 6 years ago. 6 years later I can't get plates cause they say I never payed them that they want to see the receit from 6 years ago. WHO THE F*** ARE THEY TO PUT A HOLD ON MY MTO ACCOUNT WITHOUT A COURT ORDER. Why don't they have to use a collection agency like every other tax paying canadian company. I live 64 km away from work and am a single father and may be without a van to get to work. there are no buses or trains or even cabs where we live. did i just loose my rights as a canadian? they don't take your licence away from a dead beat dad if he needs his car. even if he owes 50,000$ but they will take your right to drive away over a 5-600$ bill that might not even be legit. please help me with this matter. tomputman@canadianphonebrokers.com

    From 1999 – 2002 I was charged ridiculous amounts from the 407, i called and waited on hold for hours, never getting through. I wrote letters of complaints to the company without response. I still received bills with various account numbers on them with all kinds of outrageous charges. I even had to put up with collectors calling at all hours of the day harassing me.
    I did not owe the 407 these amounts, nor did I have any more than one set of plates so how I was being charged for various accounts was beyond me.
    I have since moved about 5 times, have a new car and a new set of plates. Last year I had to pay $50 to the MTO for 407 charges, which I paid because I probably owed about that. Just last week I went in to renew my sticker agin, just one year after paying the $50 charge. Guess what? MTO says I owe the 407 over $6300 now. HUH? I may have driven that road about 9-10 over the past year, so you are telling me that from Mississauga to Scarborough and back costs about $630? Wow.
    I contacted the 407 immediately and was told that there was an old account from 2002 that was for over $5000 which had been closed and I am to pay this. I could not get any information on this account because they said the account was closed.
    I hate this company, always have and always will.
    Now what do I do? I have two children and I have to drive to work, I guess I will be doing it illegally now? How else will I get to and from work or the doctors or grocery shopping?

    Let me know when we will take this company down as they so deserve!!

    I too am having problems with 407..I have not used 407 since 2000..this year 1158.00 is tacked on to my license renewal, I've called the Ministry of transportation but they CLAIM their hands are tied…They have an apgreement to collect any outstanding amounts the 407 says is required..
    With all my calls back and forth between the ministry and the 407, including the 407 Ombudsman, I got NO WHERE..called my MPP and they called 407..NOW the amount was reviewed and it is close to 2500.00
    No one is required to PROVE amounts or justify…the only way to get anything from 407 is to sue..I am in the process of TRYING to find a lawyer to assist..If there is anyone else in similar situation, why not do a "GROUP" request under one lawyer..My plan is file a court injunction to have the fees "owed" 407 removed from my license til the dispute is over..
    We will see what happens..

    Well, You can Imgain. I can waste a bunch of space telling my story too. As of today. I have even been on the 407 to my KNowledge. I live out in Belleville, on.. I ways aways from the highway in question.. I travelled once to a familiy reunion and may have got on, but not sure, and they can not tell us the date we were on the highway of such said date.. I am not sure whatthe going rate for a toll highway is, but I am sure a 379.81 bill is not the going rate( or maybe it is in our province) of course now my wife cannot renew her plates til it is paid. Yet they can not tell us when we road the highway, or how the ammount became so high, as we were never notified at anytime that we even owed.. Please if anyone has a solution or a number or anything that ay help, please reach us, as we are finacially set enough to fork out that kind of money when we dont owe it…

    This pas tMonday I went to the licensing office to renew my sticker and was denied because they said I owed the 407 ETR $914. I have never, in my entire life driven on the 407 ETR. I do not drive on any of the 400 series highways because I have a phobia of merging into oncoming traffic. The charges are on 3 plates which they claim are in my name. One is the current plate on my vehicle with fees having been charged prior to 2006. Another was an old plate on my daughter's car which was written off due to an accident in 2002-2003 and the fees are prior to Nov. 2003. My daughter may have used the 407 then a couple of times but not to the tune of over $800 (most of the fees are on this plate). I have been advised that the majority of the $800 fees are interest.

    They advised me that they charge 26.82% interest compounded monthly.

    I am trying to fight this but am running out of resources. I have contacted the 407 ETR and have a customer advocate (talk about spin doctoring) looking into the case, I have contacted Denise Peltier's office and they advise me that they will try to rush the investigation. But these are all 407 ETR employees, so whose interest is their priority? I have contacted an individual at the Ministry of Transportation who is responsible for 407 ETR enquiries and he said he would get back to me, which he has not done. I have sent an email off to the Minister of transportation. I have sent an email to the Premier of Ontario. I have phoned and emailed my Member of Parliament.

    I have also researched the internet and came across some legal documents dating back to 2003 wherein a class action suit was being commenced against the 407 ETR. This suit was stayed because they reached a settlement. The charges in the suit pertained to a violation of the criminal code related to the amount of interest charged and the amount of Late Payment Fees being more than 60%. There was another fact in the suit document questioning whether the government was acting in "ultra vires". I don't quite understand this one because all I could find was that "Ultra vires" related in some way to a government doing what was legally not permitted.

    My own line of thinking is along the lines of :

    My right to access a government service, namely the licensing of my vehicle in line with government regulations that it be properly licensed, has been denied to me in favour of the interests of collecting fees for a private corporation. Somehow, this does not sound to me that it is an appropriate action for a government to take and I am wondering if my rights as a citizen and taxpayer are being violated. Does anyone have any ideas about this?

    Another aspect of my situation that really bothers me is that an account(s) in my name has been established with a corporation to which I have not agreed. I know that the legislation states that the plate holder is liable, but this still seems very arbitrary and somehow seems to fly in the face of contract law. In my case, an account was established in my name without my knowledge or permission. Does this then set a precedent for any company establishing an account in my name, say since they photographed my licence plate in their parking lot, and then claim that I owe them all kinds of money?

    I'm prepared to battle this as far as I can, but I sure could use some guidance as to how to continue.

    I'm pissed also they say i owe them $9000.00 and won't let me get my sticker. What really pissed me off was they changed the rules after the fact. They say i owed that money before the rules changed, if i knew my sticker could be effected i would never have used that road. Mobsters, i wondered who got payed off in our government to let these guys make there own rules. I should sue.

OH and now ur getting the run around. the interest rate is fuckin legal do u think that a major corporation would be charging an iilegal interest rate!!!! STOP LYING, PAY UR BILL OR PUT THE CAR IN SOMEONE ELSES NAME. if they are willing to take a chance on ur lying ass!!! most of these posts are here gaining ur sympathy when u know u are all liars!!!! by the way CITI FINANCIAL CHARGES 29% oh but i bet u owe them too or u can get a loan with them.

    Write up a letter notifying the ETR and the Ministry that you do not accept the charges and request arbitration or court proceedings be initiated immediately ( make sure you have a Notary Public stamp that letter off keeping a copy ..or see have a lawyer draw it up … don't let himher hit you up for a job right away. Also request that any actions currently be taken against you be dropped until the case is heard ( give them 30 days — sorry ). AT that point if they still won't let you tag your plates see a lawyer or givce it a go by yourself to get a court injunction.

    You might also get an injunction based on time limit for filing a civil suit.
    In Ontario, it is now as litle as 2 years for certain low level crimes. So, if
    you were not contacted about an outstanding fee before the time limit the court might squash the case gainst you immediately. Contact your local MPP / Ministry / etc.

    annot get my sticker for my plate from a bill from 2000 , i still own this car and now i cant get a sticker for another car in my name but the plate hat the charges were originally on still exists so the just moved this bill onto a plate that had nothing to do with these charges . pls help . the original bill was 120. now its 2500. why did the not block my stcker 8 years ago

    I have read most of the complaints and stories about the 407 corp. The Ontario government is afraid or not willing to bring down this company and the federal government doesn't care. I have discussed this situation with a couple of lawyers and they have suggested a class action law suit brought against this company may open the eyes of the government. It may also be justifiable means to rid this province of a foreign company that is ripping off Canadians. I am one of the people that has had my life and my employment stiffled by this company being allowed to do the things they do. My credit rating has taken a hit and I cannot license my vehicle. 407 claims that I owe them for use of the toll road. Very confusing as I paid the bill for my use with a transponder, but they claim I have another account that I owe for.     No where in there does it say that the ETR is exempt, nor does it say the ETR Act they are exempt from the Limitations Act.

    They have two years to make contact for a bill in a proper manner according to how the laws of Ontario and Canada state they must make contact. After that, it cannot be applied. If they didn't send you a bill to your proper address within two years of the "incurred" bill with adequate time to pay said bill or dispute it they cannot collect that bill, they must write it off.

    Their interest rates also break the criminal laws of Canada. They don't like being threatened with the media either. I'm in the process of disputing a bill from 2004 (November) that isn't even mine because the plates in questions were lost and the vehicle in question was fubar (engine problem), uninsured and in the end was repo'ed by the finance company (we went through bad times financially) then we got it back when we paid the balance to the finance company and sold it to someone else in Newmarket. The plates at that point were gone, lost and our new vehicle has new plates now. They tacked it on to our new plates, I find this ability to find out our MTO information a violation of Chartered Rights to privacy and the Privacy Act.

    A class action lawsuit needs to happen. Count me in if it does happen. weareamped at gmail dot com. I don't know if I have money to join in on the class action lawsuit but I'll certainly try. I have two disabled kids who rely on that mini-van we have and five kids altogether. That's a lot of groceries, doctors appointments, and various activities. I work part time because that's all that is available in Elliot Lake, Ontario lately. My husband can't find work as a trucker here at the moment and decided to play Mr. Mom.

    How do they expect you to pay a bill if they remove your means of income? Not that the bill is mine in the first place anyway. I never used the ETR and the only time my husband did was with the work transponder from his boss (the plates were his bosses tow truck plates too). I don't understand how they can come back at us 5 years later after the Limitations statute has run out.

    Tolls in U.S are much better if u have change you use it if not you don't, but up here the Ontario gov have given them long hands. I used 407 6 yrs ago on 3 plates of mine I'm scared to find out how much I owe..probably $15000 lol my license is expiring in 2011 by then I'll either claim bankruptcy or move out of Ontario. The amount that 407 charges for past due accounts ceases being an interest rate and becomes a punitive excess fee (money grab) when the prime is in the single digit range and the 407 charges 26 % . This is where the govenrment must act to protect the public from chicanery.

    I questioned them about the $18 enforcement fee and never received an adequet answer. All I was told is that this fee is due to plate denial and is the cost of the 407 notifying MTO to deny plate renewal. My question to them was, "Why am I being charged $18 numerous times in a year for something I should only be charged with at the most, once a year?"
    Last year I had 4 enforcement fees of $18 on an outstanding amount of $48. That's an additional $72.

    I just got a bill from the 407 ETR saying i owe them 26.44 in interest for an enforcement fee that they tacked on about three weeks before i paid the ministry off in full over two years ago. WTF?????????? So now when it hit's collections and i get another notice of denial, it's because of an enforcement fee from over two years ago that they claim they can charge but for some reason the ministry doesn't include for amount paid and now they're gonna tack on another one which will probably not make it to the ministry, i pay it again….okay wait a minute…is it just me or is this a cycle? THIS IS ILLEGAL!!!! Where the HELL IS our government on this? Maybe people are right, the mafia really does own the 407etr that's why the government are too much of a coward to do anything about it….So many millions of people….how can this still continue? I say somebody blow up the headquarters. IF anyone is looking for a target make the 407ETR maybe that will get their attention!

    Rumor has it that some underground militia is recruiting individuals across Ontario to engage in the "accidental" and legal interruption of 407 camera operation at strategic intervals/ locations along it's entire length.

    I am not sure of the details other than assuming a day here and a day there of unverified traffic in the hundreds of thousands may get their attention. I only wish I had been the one to think of it.

    Plate denial and fee collection by my government on behalf of a private company is ludicrous!

    I am about to compose a letter, as suggested above, to the Ministry, 407, MPP, and to my local newspaper. Moved to north-western Ontario 9 years ago so definitely not using their highway. Guess charges are for transponder that I returned to them!!!! Pretty expensive piece of plastic!

    Has ANYONE had any success disputing with the appointed ombudsman, 'Denise'? [Seems to me she would be biased. ] Is there any sense at all spending time and energy with that method?

    Like others, my past disputes over the years, even though put in writing, were ignored and bills just kept arriving.

    Wondering if there is there a class action group in motion now? If so, please post contact.

    Thanks. This discussion has helped today. I hope we can eventually claim back our civil rights. If not, I doubt I can talk myself into thinking my vote matters anymore. I'm thoroughly disgusted that our government and courts have allowed this to happen. Shame!

      Sometimes (as you grow up),… Something called LIFE happens. Which can be unpredictable.
      Leaving you with something called DEBT.
      Once in debt,.. services will work with you or at least you have options to settle the debt.
      ETR (services) are a private company using our government managed driving privileges as black male.
      You talk like money grows on trees and we are just being irresponsible…..
      It's called "getting screwed!….
      Some of us don't like getting screwed and come to these discussions for help!
      Someday you will need help too. And I hope all you find are people with you're attitude.
      Do you work for ETR?
      Because I would rather pay fines and fees to my government than you crooks!

    Maybe we could try this tactic.

    I would imagine that the 407 has a really tough time with billing all these cars. Why don't people ask for a detailed breakdown of the bill? They either don't want to produce one because it will show the charge is mostly interest or fees, or they can't produce it because thier billing system is a mess. How can they blindly claim you owe them money when they don't show you how you owe it? If you call about your CC bill, they can tell you anything you want to know. I have a an outstanding bill with them right now but it is not huge and I am not disputing it. I am going to try to get them to send me a breakdown of the bill.

    I can't believe these theives are still at it. I have been fighting with these people for 7 years now over a bill that I did not incur with them. Albeit I used to use their highway but received bills after I had sold the vehicle and got rid of the plates. Now they have attached it to my credit rating and I am being denied not only my vehicle plates but now a mortgage on a house because of these bastards. Our government will not do a thing about them. Its a great racket for them. Their dispute process is a joke. I have assured at least 4 times now that this has been taken care of and will no longer be an issue. Sure it is. They just keep adding on interest. At some point someone has to step up to the plate and do something about the unethical practices of these people

    Throw a wrench in the 407 Accounting gears !!! My wife owes them $265 for 20$ bill that got lost and forgotten…We've talked to dozens of ppl including the OB with no help (we want to pay bill, not the ridiculous interest..or at least not all of it – ie let's get this resolved fairly…ha!). Here's how I propose to deal with this. Statistics show that it costs anywhere from 15$ to 28$ (depending on industry and some other factors..) to process a transaction such as a bill. They use their time, manpower, systems etc… We are going to send them weekly (or even daily..) post dated cheques for like $3-$5. Imagine if everyone (in this post alone…)sent them a fat stack of PD cheques. They'd have their money but at what cost to them !!! If you do plan on paying your bill or at least making the "effort do it this way and at least you can feel like your F–king them a little.

    does anyone know how to get a RIN number from the Ministry of transportation? I heard that with this number – instead of going under the driver license number one can actually get a sticker (I guess one might have to order personalized plates?)

    The 407 is seeking $1600 for tolls they say I used in 2000, Most of it is interest. They admitted that they dropped the ball some where
    And don't know why they didn't send me bills , But I still have to pay. The blocked me from getting a validation sticker in Dec. of 2009.

    This made for very interesting reading – Thank you. If there is a class action suit against these banditio's I'm all for hearing about it because the ETR blackmail situation has gone far enough without resolution for far too many "legal" taxpaying, decent folks in Ontario. Every time I turn around it seems another person is being blackmailed by this legalized Mob. To the naysayers in this group who simply suggest that people "pay their bills and quite whining" I say nay to you. If we owed it it would be paid. But these people are running amok & levying rates a loan shark would envy. I am sitting here looking at a Money Order for $ 25.00 made payable to the ETR a few years ago. It was to settle a $7.84 cent underpayment that was apparently missed in 1997. That was the last I heard from them for years. Nonetheless, the ETR said it happened (therefore it must have). But they can't (or won't) prove it and refused to send me a statement before we came West in the year 2000. I was supposed to just take their word that my payment had been late & shorted sometime in 1997. Nonetheless, I paid them $25.00 (which is over three time the amount originally due them). I wouldn't buy a pizza from Piza Pizza without a receipt and here I was forking over $25 + $5.00 for the draft without proof! It wasn't enough. They then contacted my elderly mother and threaten her (thinking it was me) looking for the balance that had accrued to a rib busting $465.00. Not once …. but approx. 15 times. It didn't matter that she told them her daughter had been living out of Province for many years …. They didn't buy her "story". (My mom was 84 yrs at the time). She has never even owned a D/L; never mind travelled the ETR. In 2007 they surfaced out of the blue again. I advised them NOT TO call my mother and harrass her again or they'd be hearing from our lawyer. She now wanted $465.00 + additional interest but said she would "do me a favour" and reduce it to $100 if paid them right away (???) and she would then credit me back the difference. WTF? I've been considering finding a lawyer here in AB, but if there's a class action suit I'd sure be open to hearing about it and cornering these clowns in court! By the way …. I'm guessing most of you folks pay taxes just like I do in Canada. I was born, raised and paid taxes in Ontario a good portion of my life and voted for the very same clowns that you did – I hate to admit this to myself but it appears these same MP's have conveniently turned their backs on this fight against the ETR. Canada was recently voted as one of the worlds LEAST corrupt countries … Nonetheless; when you see the deal they cut to protect these legalized bandito's it kind of makes you wonder eh? I started a Facebook group called "Stop the 407 ETR's Abuse of Power!" The government acts like they are helpless when the 407 puts you in plate denial. They are not helpless. I need an army of people behind me. There is stregnth in numbers. I have a reporter that may be interested in helping us. The Ministry of Transportation are the landlords of the 407 and as such has a responsibility to do something when the public is being harmed by their tenants.     Every year now it seems I have to pay, I have not been on the 407 in 7 years, yet their is always a bill, if its not one account they make up another. Last bill I got in the mail was a service charge to send me a bill for ZERO dollars. So now the interest starts on the service charge. If I did this I would go to jail for fraud. But No its legal for the 407. I am ready to move from Ontario because of this BS.

    Hey everyone, the Ontario government does not own the 407. It is actually owned by a multinational based in Spain. When the government of Ontario considered attempting to nationalize the 407, the Spainish company threaten to put sancations on Canada, and of course the whole EU would follow suit.

    Same problem as most. Used 407 back in 2000/2001 paid all bills. 2 yrs later when I went to get my sticker renewal, Denied for not paying. I Showed them my receipt for the exact bill their computer said wasn't paid. The told me "disn't matter" I had to pay because the computer said so. I was told I would get a refund afterward in the mail. I got a credit!! I live in northern Ontario. I haven't been on the 407 since but I got another bill several years later in the amount of the credit. I couldn't resolve the issue. Then I got 2 separate bills from 2 plates. Still unable to resolve. it has gone from about $150.00 to around $1,000 The last few times I tried to resolve this, I was hung up on by their agent. I am told they will deny my sticker when I apply next month. Guess I'll be driving without one. These are call center mentality people. If you start a class action suite, let everyone know I will support it.I

    I have a $1000 bill, now grown to $5300, I tried for exceptional hardship plan, that is just a way to get $31.50 out of you. Plus even if they are in error, you pay in full.
    Anybody had any luck with arbitration (Bill K, May 14,2008) or small claims court.
    Please let me know of any protest groups, Class Action Suites, as the 407 is impossible to negotiate with.

    I just received a lawyers letter demanding over $11,000.00 for two accounts with 407 ETR. I haven't lived in Ontario for almost 10 years and I have never received so much as a statement from 407. Yet I have 10 days before legal proceedings start. I have sent a notice of dispute to 407 ETR, their lawyers, the ombudsmen Peltier and Kevin Sack who is supossed to be some relations vp…… and yet no response from anyone! Automatic response from 407 and Denise Peltier but nothing else. I don't even have a bill to dispute or pay. I am furious to think they are trying to push this through legal proceedings to get a court order against me. When I cal they just want my phone number and address for their data base ! No customer service at all! Any help would be greatly appreciated – I don't know where to turn for help!

    Rackteering….defintately!! I agree that the interest compounded monthly is not criminal but it does become criminal when interest/costs (due to deliquencies) amounts to over 60%. That is very clear here to what the 407 is doing. I'm sickened with knowing that the ministry of transportation is affiliated with this type of activity. I'm in the same boat as many of u. Even though my toll charges r legitimate I have neglected payments earlier on due to my financial situation. I live in the niagara region but work in Toronto due to the type of profession I'm in (and cannot move to TO) so I have to take 407 otherwise I have to leave at 4 in the morn instead of 6. I work 24 hr shifts so I only use the 407 8 times a month(only going to work, I sit in the traffic going home). I'm not looking for sympathy. I'm looking for help. My bill has reached over $5500 and I'm making $300 payments and can't bring it down. It's on the rise to a point that I can't catch up. I'm driving with an expired plate because I have no choice but to do so. This is ridiculous. I understand I'm at fault for not paying on time but they shouldn't make it so impossible to pay it off. Please advise.

    I am not one to be bullied or intimidated, so I have taken on the challenge. They want EXTRA $$ for service fees for June 2010 because I used the 407 prior to June 27th and again on June 28th. In my mind that is the same month but they say it is not. They have a different calendar than the rest of the world. They want to double bill me for VIDEO TOLL CHARGES for the period.

    The "President's Office" responded (that is a CALL CENTRE – you can hear them all in the background) by phone and finally by e-mail (I insisted that all communications be in writing for the settlement proceedings). They just keep saying the SAME THING OVER AND OVER AGAIN.

    This evening I have asked them to comply with Section 17(6) of the Act and that if they make any attempt to enforce plate denial I will seek damages for all cost to my company.

    It may seem petty to argue over $20 in video charges but if you multiply that by the number of people on the ETR it is HUGE DOLLAR VALUE. The ETR must be held accountable.

    The DISPUTE ARBITRATOR under the ACT is not the OMBUDSMAN for the ETR, it is a provincially appointed Arbitrator. Section 18(2) of the Act says that the OWNER (that is the ETR 407) has to pay those costs. If the ETR gets flooded with people using the Act to make claims, they will have a lot of bills to pay to the Arbitrator – so they might listen.

    DON'T BE BULLIED BY THE ETR!

    WOW! I got a response already from the OMBUDSMAN and I have appended those comments. YOU HAVE TO READ what they say that it is "the final appoint of appeal for a customer".

    That is not what the "Highway 407 Act, 1998" states, as in Section 18(1) of the Act the "dispute arbitrator" is appointed by the Lieutenant Governor in Council (aka the Government of Ontario).

    The process of Arbitration in Ontario is very well established. It is not a ONE SIDED affair where the collection party assigns an arbitrator.

    Here is what they said:

    I received the exact same automatic response too! The Ombudsman office does nothing to help! I am now dealing with the lawyer Robert Izsak representing 407 etr. Through e-mail only, I refuse to communicate without it in writing. All I want is the proof of the trips so I can prove the bill isn't mine…….it's been over a month and so far an invoice for $400.00 with no evidence. Yet they want over $11,000.00 from me? He's playing a game and avoiding my request for proof. I asked about the Ontario Statute of Limitations ~ he said he would explain hoe it works regarding 407 etr. I expect this to be interesting and will post when I get it.

    Its appears so many of us have experienced the same treatment. I did contact my lawyer. My case is simple. I have never owned a vehicle that was licensed. I recently received a bill in the thousands. There is no evidence, no file available that shows any proof of me being on the 407etr. Somehow they are sending me invoices. I do not have any plated vehicle even today in my name. I sent the info to an attorney. This is what I got back:

    You will not be able to validate a plate until the bill is paid or otherwise resolved. The Registrar has no discretion or jurisdiction to issue you a plate (see newspaper article). You can try the dispute process but you have missed your deadlines. A law suite is not practical, it will cost a minimum of $10,000.00 if you hire a lawyer and take years.

    He sent me the problem!!!! THrough an article. The Ontario Government sold 407ETR to the spanish consordium and gave them a guarantee that they would collect for the 407ETR. They tried to change this in a suit but lost. One Markham Car dealer did sue 407ETR and wnn back in 2006. The suit was won for $50,000…but the costs were years of litigation and legal fees.

    Most big corporations today are using similar tactics.ie Rogers, Bell etc. They just don't have the right to suspend your plate renewal. They have a team of lawyers writing there own laws that do not stand up in court. The problem is you have to go to court. They run away like morons when you do go to court. But…everyones afraid to plead there case in court. Go figure. They know this. Lawyers win in the end always.

    Solution: Don't Pay, send all your complaints everyday to you government officials. Every chance you get call them and have long conversations on there 1800 numbers. Use up there time. When I'm bored I just call them up and gab and gab and record… ask for names, information…..For fun! Deny, Deny Deny. Record all bullsh*t conversation and post them on Youtube.
    NEXT:Register an incorporation, $450.00, put your plates under your company name. DO NOT GO ON THE 407ETR!!!!! Fools! They are the MAFIA. We should all incorporate ourselves anyway, you can claim back all your HST paid out. Open up your own bed and breakfast. Its free with tax deductible benefits.

    Otherwise: big moneys won,…..we let it happen..

    I used the 407 for the first time my charge was only $12.70 which I have no problem paying. The problem is they have stuck me with a $161.39 invoice for the person who owned the plates/car before me prior to them being transfered into my name. The letter from the 407 acknowledges that the fees and related interest was previously incurred by a prior owner . The charges are for more then a year prior to me owning the plates/car. They said since I am now the new current owner of the same I am responsible for all the outstanding amounts or they will send me to collections or refuse to renew my plate. Why am I responsible for someones elses debt? How is this even legal and why wasn't the prior persons license plate renew refused until they paid it? How can the 407 get away with stuff like this?
